The juridical company “SOVILEX CONSULTING” S.R.L. registers maritime & river ships in the Register of Ships of Republic of Moldova.

The National Safety Navigation Agency registers the ships & is subject to the Ministry of Transport & Communication.

There are no limitations in registration, as well as procedure differences dependent on the ship’s age.

The river ships & the sea-river ships of any age & standard (tankers, dry cargo ships, passenger ships, lighters & others) are registered by the National Safety Navigation Agency.

The National Safety Navigation Agency also fulfils:

- The temporary ship registration by the contracts of leasing & bare boat charter;

- The temporary ship deletion in the Register by the contracts of leasing & bare boat charter;

- The registration of bails.

Those shipowners who wish to register the ship in Moldova are obliged to assign his local register agent for all period of registration.

 

The following documents are necessary for the ship registration in the Ship Register:

the power of attorney in moldavian & russian certified in the legitimate order;

the statement with the indication of:

• full denomination & location of the shipowner;

• previous & future name of a vessel;

• previous ship’s registration;

the original or the notarial attested copy of a Bill of Sale or other documents which certify the ship property law;

• the basic constituent documents of the ship owner;

• the deletion certificate ship’s registration;

the form of the Ship Register;

the photo of the ship & its plan-scheme;

the copies:

- the measure certificate;

- the classification certificate;

- the certificate of ship’s fitness to the voyage;

- the certificate of radio correspondance equipment to international standards (with the enumeration of all radio equipment);

• the shipowner get the following documents on the registration:

- the certificate of ship’s property law;

- the certificate of right to voyage under the flag of RM;

- the certificate of minimum safe ship’s crew;

- the license of ship radio station.

Tariffs

The shipping register tariffs in RM differ from these ones of neighbouring countries in lower tariff rate.

The shipowner must pay for the period of registration & every year afterwards:

- The register tariff;

- The certificates;

- The radio-license, identification & other codes;

- The local agent service;

- The lawyer’s fee.

The base of the tariff calculation is the gross register tonnage of ship. The Tariff calculation is effected on account of ship’s standard & age expressed in the coefficients.

The technical supervision & the classification societies.

The technical supervision in RM is fulfilled by the National Classification society – the Inspection of the Register of Ships of Republic of Moldova (Inspection), which is included in the National Safety Navigation Agency.

The Inspection supervises the river & sea-river ships. The Inspection complies with regulation of the Russian Maritime Register of Shipping. The Inspection entered into an agreement of reciprocal delegation of powers.

- the Register of Ships of Republic of Moldova;

- Russian Maritime Register of Shipping (RS);

- American Bureau of Shipping (ABC);

- Bureau Veritas (BV);

- Germanischer Lloyd (GL);

- Lloyd’s Register of Shipping (LRS);

- Registro Italiano Navale (Rina);

- Det Norske Veritas (DNV);

- Nippon Kaiji Kyokai (NKK);

- China Classification Society (CCS);

- Korean Register of Shipping (KRS).

The legal service cost.

The legal service on ship registration is evaluated in 800 EURO.

The cost of:

- Certificates (3) – USD 150;

- Agent – USD 400;

- Radio-license & codes ~ USD 350

Law of Shipping.

Republic of Moldova is member of IMO & the Danube commission. The principle enactment of RM, which regulates navigation relations , is the Code of Trade Navigation (CTN), the Law ¹ 599-XIV September the thirty 1999 published in ( Monitorul Oficial ¹ 1-4 January the eleven 2001).

In accordance with the CTN of RM, Law ¹ 334-XV July the twenty- four amendments those ships can be registered & can receive the right to voyage under the flag of RM, whose possessors are physical & juridical persons, as residents so non-residents, as well as the ships exploited by above-mentioned persons in virtue of contracts of bare boat charter or leasing.

Shipowners & freighters, who registered their vessels in the Register of Ships of RM, are tax-exempted & free from customs duties.

Chapter 2.
The right to voyage under the flag of RM.
The registration of ships.

Section 30. The right to voyage under the flag of RM.

The right to voyage under the flag of RM is given to ships registered in the Register of Ships &:

a) ships which belong to physical & juridical persons of RM on the right of property;

b) ships which belong to foreign physical & juridical persons on the right of property;

c) exploited in virtue of contracts of bare boat charter or leasing.

Section 31. The obtaining of the right to voyage under the flag of RM.

(1) The ship obtains the right to voyage under the flag of RM from the moment of registration in the Register of ship.

(2) The shipowners & freighters, who registered their vessels in the Register of Ships of RM, are tax-exempted & free from customs duties.

(3) The shipowners & freighters registered their vessels in the Register of Ships of RM are responsible for the violation of enactments, regulating the international navigation, in accordance with the legislation in force.

(4) The ship acquired or constructed in another state has the right to voyage under the flag of RM in a moment of the obtaining of corresponding certificate from the consult of RM. The certificate is valid until ship registration in the Register of Ships, but no more than one year.

(5) The ship which uses the right to voyage under the flag of RM has state nationality & must setting sail under the flag of RM.

(6) The flag hoisting of RM in the absence of corresponding right leads the responsibility provided by legislation .
